I have 2 daughters, ages 8 and 5. Their father and I divorced 3 years ago because of his drinking problem, although he has never been formally dx as “alcoholic”, I was married to and lived with him, so I know. His Mother and I had an Intervention with him in an effort to get him to get help, he said he would and didnt, so I left with our children. He has overnight visitation with our children every other weekend. I always make a point to watch him closely for signs of alcohol when he picks them up/drops them off, and am SOOO relieved when they come home safe!
We have a court date in January because he insists on taking them to a friends house to spend the night, where they sleep on the FLOOR and he sleeps on the SOFA! I believe drug and alcohol activity goes on, but cant prove it. This past weekend he dropped the girls at their Girl Scout meeting, and stuck around. Later that evening their Troop Leader called to tell me that he smelled of alcohol when she got near him. I was there too, and we both agree he seemed fine. Unfortunately, he almost always smells that way, even though he doesent appear drunk!
I dont necessarily want to have his Visitation taken away, but I want the girls to be safe. I am asking for the Court to change Visitation to either Supervised Visitation or day visits only, so I know they will be safe and have a place to sleep.
How do I prove he has drinking problem?
I filed for an Emergency Hearing the other day. They should be getting back to me. How do I get the police to take a blood test?
Actually, our “intervention” was not done with a professional, just his mom, me and him. I took the girls to my Moms house so we wouldnt be interrupted. When I try to talk to the girls, they clam up and get very protective of him, he bad mouths me terribly to them.

Stage an emergency situation and have the police take blood during the incident.
