i have to go to a hearing tomorrow because i plead not guilty to a public drunkenness charge that i got about a month ago. the fine seems a little extreme ($ 230) and would definitely mess up my money situation. I’M 21 AND THIS HAPPENED IN PA.
i was in a college town near where i live on a friday night. i met up with a friend of mine in the parking lot of her dorm. i was drinking a beer and just talking to her, not being loud or stumbling around or anything like that. a campus police officer pulled in and proceded to tell me that you can’t have ANY alcohol on campus. i honestly did NOT know this. i wouldn’t have went anywhere near there, had i known. there were no signs anywhere and i’ve asked several people if they knew that you couldn’t have alcohol on campus almost all of them said that they didn’t. so it’s not common knowledge. and i thought that because we were right outside of where she lived it wouldn’t be considered “public”. i saw people drinking all over that night.
why should i think i can’t drink just down the street? i mean, if there are people near me doing the same thing and nobody gives them any shit, why would i be worried.
i voluntarily took a breathalizer (.081) which might have been a mistake. he didn’t tell me i HAD to, he just asked if i wanted to see how “drunk” i was. i’d never been breathalized before so i thought “cool, why the hell not?” i wouldn’t have normally volunteered but he was acting like he was just going to let me off with a warning. i’m sure this doesn’t matter but he was acting like a total prick. he treated me like i was some kind of violent criminal or something. i SET my bottle on the ground and he made some smart-ass remark about fining me for littering. and even though i wanted to hit him, i still cooperated completely. do you think the judge would let me off since i didn’t know? i have no priors, by the way.
i appreciate any advice you can give.
