No Alcohol Signs to Print: Legal Help With Billing Problem From Guthy-Renker, Please?

Question by chelly: Legal help with billing problem from Guthy-Renker, please?
My issue with Proactiv/Guthy-Renker:

1. I bought Proactive 30-day trial for $ 19.95. (Two 2oz & one 1oz bottles)
2. They charged me $ 29.96 the next month for 60-day supply. (Two 4oz & one 2oz bottles)
3. I knew nothing of the charge, so I cancelled my account and the representative told me that I would not be charged further at all and I could get the $ 29.96 refunded if I return that charged shipment, or keep it and let the $ 29.96 stand.
4. Too much hassle to send it back, so I kept it and assumed I’d have no more troubles from the company.
5. They charge me another $ 19.95 yesterday…
6. I call the company and the representative tells me it’s to pay for the last shipment… for which I’d already payed $ 29.96. (So I payed $ 49.91 in full for a 4oz each of soap, rubbing alcohol, and zit cream.)

At my first purchase, the trial, there was no information saying that I would be charged each month thereafter for more of the product. The website says now it charges $ 19.95 monthly for 90-day supply, but it did not in August – and anyway I was charged $ 29.95, not $ 19.95, and I got a 60-day supply, not a 90-day supply.

Neither the invoice with the $ 29.95 shipment nor the customer service representative informed me that I’d be charged an additional $ 19.95. On the contrary, the representative told me that was the last charge.

I couldn’t care less that it’s “only twenty bucks.” If Guthy-Renker charges a random twenty bucks to ten thousand customers that’s an extra $ 200,000 of profit for the company.

Isn’t this Fraud? False Advertising? Even if the charges are in some stupid “disclaimers” or “fine print” wouldn’t they be unconscionable because they’re completely not obvious?

Oh and when I asked the representative for account cancellation confirmation, he told me the company couldn’t give me one. Isn’t that kind of fishy?
Stopped any direct debits? I don’t know how to make them stop charging my account! I can’t log on to the website because my account is cancelled, but they still charged me!
Another big, big problem: I don’t have the invoices anymore. Apparently, last time the trash went out to the curb, so did the invoices. I don’t know how or why or whatever, but it doesn’t matter, they’re gone.

Am I royally screwed?

What contract did you sign, I agree it’s fishy, stinks to high heaven.
Write to them with all you have put down here and keep a copy, explain that their harassment is causing you mental illness and that you will bring all this to the attention of your local Chamber of Commerce or equivalent, they’ll soon back off.
Above all ALWAYS keep a copy of any dealings, no matter how small you think they might be, little acorns grow!
PS I assume you have stopped any direct debits to the company.
